These Terms of Service govern the use of LaunchLeaf services, including website design, ecommerce builds, hosting-related services, support, and social media marketing.

1. Acceptance of these terms

By using the LaunchLeaf website, requesting a quote, making a payment, or using any LaunchLeaf service, you agree to these Terms of Service.

These terms apply unless a separate written agreement has been provided for a specific project or client relationship.

2. Services offered by LaunchLeaf

LaunchLeaf may offer services including, but not limited to:

  • Business website design and build services
  • Ecommerce website or online store development
  • Website updates, support, and maintenance-related services
  • Hosting-related services where included in a package
  • Social media content and marketing support
  • Bundle offers combining website and social media services
  • Custom quotes for tailored business requirements

The exact deliverables for a project depend on the package selected, the accepted quote, and any written agreement made between LaunchLeaf and the client.

3. Quotes, pricing, and package changes

Package pricing, build fees, and monthly fees are listed as clearly as possible on the LaunchLeaf website or in written communication. Pricing may change over time, but changes generally apply to new purchases unless otherwise agreed.

Quotes are based on the information available at the time of quoting. If project scope changes materially, LaunchLeaf may revise the quote, recommend a different package, or charge additional fees for extra work.

4. Payments and subscription billing

LaunchLeaf may charge a once-off build fee, a recurring monthly fee, or a combination of both depending on the service or package selected.

For subscription-based services, monthly billing may cover items such as hosting, maintenance, support, or ongoing marketing services, depending on the package.

Payments may be processed through third-party payment providers such as PayFast. By making a payment, you also agree to the relevant payment provider’s terms where applicable.

If a recurring payment fails, LaunchLeaf may pause work, suspend access to ongoing services, or delay further support until the account is brought up to date.

5. Client responsibilities

To complete work properly, the client is responsible for providing reasonably accurate and timely information such as:

  • Business details and contact information
  • Service or product information
  • Logos, branding, images, and content where available
  • Access details where necessary for updates or integrations
  • Feedback, approvals, and revision requests within a reasonable time

Delays in sending content, approvals, payments, or required access may delay delivery timelines.

6. Timelines and delivery

LaunchLeaf may provide estimated turnaround times, including fast-launch timelines for standard packages. These timelines are targets, not absolute guarantees, and depend on timely client cooperation.

Delivery timelines may be affected by delayed content, unclear instructions, slow approvals, technical issues, third-party platform limitations, or scope changes.

7. Revisions and scope limits

Reasonable revisions are generally included during the normal build process. However, LaunchLeaf reserves the right to treat major design changes, repeated reworks, added pages, added features, or changes outside the agreed scope as extra work.

If the project grows beyond the original agreement, LaunchLeaf may issue a revised quote or suggest moving the client to a more suitable package.

8. Hosting, support, and third-party platforms

Where hosting or support is included, LaunchLeaf will provide the level of service reasonably associated with the relevant package. Exact service levels may vary depending on the platform, scope, and technical setup.

LaunchLeaf may use third-party platforms, software, payment providers, integrations, domains, analytics tools, or hosting systems. The performance and availability of third-party services are not fully under LaunchLeaf’s control.

LaunchLeaf is not responsible for outages, feature changes, service interruptions, account restrictions, or pricing changes imposed by third-party providers.

9. Content ownership and client materials

The client is responsible for ensuring they have the right to use any logos, images, wording, videos, trademarks, or other materials they provide to LaunchLeaf.

LaunchLeaf does not accept responsibility for infringement arising from client-supplied content.

Unless otherwise agreed in writing, the client retains ownership of their own original brand assets and business content, while LaunchLeaf retains ownership of its internal methods, systems, templates, processes, and pre-existing materials.

10. Cancellations, pauses, and refunds

If a client cancels after work has started, LaunchLeaf may retain amounts already paid for work completed, time reserved, setup already performed, or non-recoverable costs.

Monthly services may require notice before cancellation, especially where hosting, support, or ongoing content work is involved.

Refunds are not automatically guaranteed once work has begun, a build has been started, a domain or hosting setup has been completed, or a recurring service cycle has already been provided.

Any refund decision remains subject to the actual stage of the project, the package terms, and the nature of the work already completed.

11. Suspension or termination of service

LaunchLeaf may suspend, delay, or terminate services if:

  • Invoices or subscription payments remain unpaid
  • The client becomes abusive or unreasonably difficult to work with
  • Required project information is not provided
  • The requested use of the service appears unlawful, misleading, or harmful
  • A third-party platform or provider prevents continuation

12. No guaranteed business results

LaunchLeaf aims to help businesses improve their online presence, credibility, and conversion potential. However, LaunchLeaf does not guarantee exact business results, sales volume, lead volume, search ranking position, or marketing performance unless expressly agreed in writing.

Actual results depend on many factors beyond LaunchLeaf’s control, including offer quality, pricing, market demand, follow-up speed, traffic quality, competition, and the client’s own operations.

13. Limitation of liability

To the maximum extent reasonably allowed, LaunchLeaf will not be liable for indirect, incidental, special, or consequential damages, including loss of revenue, lost leads, lost profits, downtime, business interruption, third-party service failure, or data issues arising from use of the service or website.

LaunchLeaf’s total liability for any claim relating to a service will generally be limited to the amount actually paid by the client to LaunchLeaf for the specific service giving rise to the claim, unless a different standard is required by law.

14. Changes to these terms

LaunchLeaf may update these Terms of Service from time to time to reflect changes in pricing, services, business operations, or legal requirements.

The latest version published on this page will apply from the date it is posted, unless a separate written agreement states otherwise.
